Thanks to this tool, you can now check the presence on a sanctions list of any of your crew members, passengers, companies or even aircraft. It provides you with insights that might be useful before the flight even starts. Why is that important?

The law and its consequences.

If you are working with an entity that is on a sanctions list, international law introduces some aspects of an almost virus-like procedure that could end in you being subject to sanctions. The same is also true when a company added to sanctions lists contacts you. In some parts of the world, you are obligated by law to report this to the authorities. 

That’s why every entity must be checked before departure to determine whether they are on a sanctions list or an anti-terror list. If this is the case, it is not permitted to carry the passenger and heavy fines can apply if this is overlooked. 

As you can see, knowing who you work with before a deal is concluded can have a massive impact on your business.

The background story.

Following the attacks on the World Trade Center on 9/11, the world needed not only a strong response but an economical weapon to fight terrorism. Anti-terror legislation was soon tightened by the United Nations by creating a sanctions list containing those connected with the terror attack. 

After a while, other countries followed suit by creating lists of their own. The effect is that several sanctions lists apply in different parts of the world. That’s why we often see situations in which somebody on one list can still travel despite the restrictions imposed.

The UN Sanctions List is the basis for most sanctions lists relating to individuals and organizations. All states are obligated to implement these restrictions under international law. The European Union also incorporates the sanctions-related decisions of the UN in the EU Sanctions List. Other specific countries prepare additional and update existing lists.

What can the sanctions mean?

The spread of the restrictions imposed by sanctions can be extensive and can ban or limit economic, diplomatic, military, sport, or environmental activities. 

The limitations or total ban can also be applied to those working with blacklisted individuals, companies, associations, organizations or goods which are subject to legal and/or economic restrictions. 

In May 2022 and in connection with the War in Ukraine, members of the EU defined that a violation of sanctions will be punished more severely than before and stated that it will be included in the list of EU crimes.

This inclusion in the list of EU crimes could lead to the definition of a common standard for crimes and punishments within the entire EU. Such common EU regulations would in turn make it easier to investigate, prosecute, and punish breaches of sanctions in all Member States the same way.
